Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AttractionBot (the “Service”), provided by [YOUR LEGAL NAME] (“we,” “us,” “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

AttractionBot is intended for owners and operators of non-medical, client-facing service businesses, including but not limited to: spas, estheticians, lash and brow studios, hair salons, makeup artists, wellness coaches, and similar businesses operating outside of regulated healthcare.

You may not use the Service if:

• You are a HIPAA Covered Entity or Business Associate as defined under the Health Insurance Portability and Accountability Act (United States).
• You are a Health Information Custodian under the Personal Health Information Protection Act (Ontario) or analogous provincial health privacy laws elsewhere in Canada.
• You intend to use the Service to collect, store, transmit, or process Protected Health Information (PHI), patient medical records, or any data regulated by applicable healthcare privacy laws.
• You are under 18 years of age or otherwise unable to enter into a binding contract under the laws of your jurisdiction.

By using the Service, you represent and warrant that you are not a Covered Entity, Business Associate, or Health Information Custodian, and that you will not use the Service to handle PHI or other regulated health information. You agree to indemnify and hold us harmless from any claim, liability, or regulatory action arising from your violation of this section.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We use magic-link authentication; do not share your sign-in links with anyone. Notify us immediately of any unauthorized access.

AttractionBot is offered on a paid subscription basis (the “Foundation” and “Builder” tiers, or successor names). Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Fees paid are non-refundable except where required by law or stated in writing.

Usage-based charges (such as SMS overages on the Builder tier) are billed in addition to the base subscription fee. We may change pricing with at least 30 days' notice; any price change will apply at your next renewal.

You agree not to:

• Use the Service to send unsolicited commercial messages (spam) or messages that violate CAN-SPAM, CASL, or similar laws.
• Send SMS or email without the recipient's express consent where consent is required by law.
• Upload, generate, or distribute content that is illegal, infringing, defamatory, or harmful.
• Reverse-engineer, scrape, or attempt to extract the Service's source code or AI model behavior.
• Use the Service to impersonate another person or business.
• Resell, white-label, or sublicense the Service without our written agreement.

You retain ownership of all data you upload to or generate within the Service (your business knowledge base, client records, quiz responses, intake submissions, session notes, consultation logs, and similar). You grant us a limited license to process this data only to provide the Service to you.

You are solely responsible for the lawfulness of the data you collect and store, including obtaining consent from your clients where required (CASL in Canada, GDPR in Europe, applicable US state laws). We provide consent collection tooling but do not verify that you use it correctly.

AttractionBot uses third-party AI services (currently Anthropic Claude) to generate suggested content, including consultation questions, treatment plans, follow-up emails, and copy. AI-generated content is not guaranteed to be accurate, complete, or appropriate for any specific client. You are responsible for reviewing all AI-generated content before sending or acting on it. Treatment plans generated by the Service do not constitute medical advice and must not be relied upon for medical decision-making.

We provide the Service on a best-effort basis but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features with reasonable notice. We may terminate or suspend accounts that violate these Terms.

To the maximum extent permitted by law, our total liability under these Terms is limited to the fees you have paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflicts of law principles. Any dispute will be resolved in the courts of Ontario.

We may update these Terms from time to time. Material changes will be communicated by email and posted on this page with a new “Last updated” date. Continued use of the Service after a change constitutes acceptance of the updated Terms.
